Chandler <br />County Administrator <br />D ON HEAD CONCURRENCE: <br />Obert eating, C <br />Community Developme Director <br />FROM: Stan Boling, AICP <br />Planning Director <br />DATE: February 4, 2000 <br />SUBJECT: Final Hearing on Proposed LDR Amendments: Defining Yards That Abut <br />Limited Use Rights -of -Way as Side Yards, and Use of Docks/Piers on Vacant <br />Single -Family Lots <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of February 15, 2000. <br />At its regular meeting of February 1, 2000, the Board of County Commissioners held the first of two <br />public hearing on the referenced LDR (land development regulations) amendments. At that hearing, <br />the Board considered recommendations and public input and directed staff to make certain changes <br />to the proposed amendments. Staff has now made those changes, which are reflected in the attached <br />ordinance. <br />At the February lg hearing, the Board was satisfied with the first amendment regarding limited use <br />right-of-way and side yard designations, as proposed. Therefore, no changes have been made to that <br />amendment. At the same hearing, the Board directed staff to make changes to the second <br />amendment regarding use of docks on vacant single-family lots. Those changes involved the <br />elimination of a bonding requirement and the addition of a requirement for home construction and <br />C.O. (Certificate of Occupancy) within 3 years of the date of dock permit issuance. Therefore, if the <br />revised amendment is adopted, owners of vacant single-family waterfront lots will be able to build <br />and use docks for their own watercraft subject to site plan approval and a condition that a principal <br />dwelling must be constructed and C.O.'d on the lot within 3 years of issuance of a dock permit. <br />Staff recommends that the Board of County Commissioners adopt the revised_ LDR amendment <br />ordinance. <br />ATTACHMENTS: <br />1.
