Wright <br />Director of Emergency Services <br />DATE: February 29, 2000 <br />SUBJECT: Tower and Ground Space Lease Between Indian River County and Florida Power <br />and Light Company <br />On November 16, 1999, the Board of County Commissioners approved a Tower and Ground Space <br />Lease with Florida Power and Light Company to place their 900 MHz Radio Communications <br />System at the Hobart Park 405' Communications Tower site. After approval of the Lease. FPL had <br />a study and survey completed which determined the tower was structurally insufficient for their <br />communications system. FPL has provided notice that they are terminating the lease pursuant to <br />the agreement effective May 7, 2000. <br />FPL remains interested in the Hobart Tower site and has indicated they may negotiate with the <br />County in the future regarding possibly replacing the existing tower, or the 150' tower. for certain <br />considerations which are undetermined at this time. In the interim, FPL is seeking a short term lease <br />on the Bailey Street Tower for their radio system transmission site. <br />The attached Lease has been revised by Acting County Attorney Terry O'Brien and it provides <br />general protections for the County as well as the following conditions: <br />1. FPL shall have the right to occupy 300 square feet of floor space in the equipment <br />building for their radio transmission equipment and space on the tower for coax and <br />receiveltransmit antenna system. <br />2. The term of the lease is for one year commencing on April 1, 2000, and ending on <br />March 31, 2001, with an option to renew for an additional one year term. <br />3. FPL will pay rent in the amount of $5,004 per year at the rate of $417.00 per month <br />during the term of the lease. <br />4. FPL will pay a one time payment of $5,000 at the time the lease is executed. <br />5. FPL will pay all Florida sales taxes and tangible taxes, if applicable. <br />6. Indian River County will receive $5.000 in deposit from FPL as security for the <br />performance of obligations. <br />7. The Option to Renew, if exercised, provides for a 4% rental increase. <br />8. FPL agrees to reimburse the County for utilities consumed as calculated by the <br />County.
