MOTION WAS MADE by Commissioner Stanbridge, <br />SECONDED BY Vice Chairman Ginn, to deny the request to <br />rezone the ±0.54 acres located on the northern part of the barrier <br />island, approximately 700 feet west of Jungle Trail and a quarter <br />mile south of CR 510 from RS -1 to RS -6. <br />Under discussion, Commissioner Macht felt the Board was somewhat "honor bound" <br />to fulfill the agreement that had been made with the owner, Mr. Collins. <br />In response to Chairman Adams' inquiry, Director Keating explained that RS -1 <br />zoning has 20' side yard setbacks and Mr. Collins' problem is the setback to the east. The <br />RS -6 zoning would give Mr. Collins the building footprint wants. <br />Vice Chairman Ginn asked if there was any other way Mr. Collins could build what <br />he wants without changing the zoning. <br />Commissioner Stanbridge was still opposed to changing the zoning on the ±-/54 acre <br />parcel and suggested that Mr. Collins could change his house plans. <br />Commissioner Tippin stated staff has spent many hours on this and he respected <br />staff's expertise. He saw no problem with changing the zoning to RS -6 on the ±0.54 acre <br />parcel thus allowing Mr. Collins an additional setback. <br />Vice Chairman Ginn agreed, but felt this would be setting a precedent. <br />Acting County Attorney Terrence P. O'Brien commented that eveg the Board <br />does sets a precedent. <br />Vice Chairman Ginn felt the Board had an obligation (to rezone the ±0.54 acre), but <br />did not want to see 3 units on the property. <br />Commissioner Stanbridge pointed out that while Mr. Collins might not build 3 units, <br />if he sold the property, the purchaser would not necessarily have to build just one house <br />there. <br />March 21, 2000- <br />109 <br />
