Frame, Director, Department of General Services -'+w ui • p- - — <br />Subject: Memorandum of Understanding between the USDA Natural Resources <br />Conservation Service (MRCS) & Indian River County <br />BACKGROUND: <br />Currently, two technicians, Clare Nichols (USDA District Conservationists) and Jim Karl <br />(County Conservation Technician), stag' a portion of the Soil and Water Conservation Office. A <br />number of landowner requests are designed by the staff such as irrigation features and ponds <br />along with sound land conservation approaches. <br />By adopting the Memorandum of Understanding (MOU), Jim Karl's activities will be <br />supervised and under direct control of Clare Nichols when carrying out work as requested of <br />NRCS. As authonzed under the MOU, Jim Carl will fall under the umbrella of the Federal Torts <br />Clarms Act when carrying out such NRCS work <br />This is in essence how work has been and is being done at the present time. The MOU merely <br />formalizes the procedure and extends the coverage of the Federal Tort Claims Act <br />RECOMMENDATION: <br />Staff recommends the approval of the Memorandum of Understanding between the USDA <br />Natural Resources Conservation Service and the Indian River County Board of Commissioners. <br />ON MOTION by Commissioner Grin, SECONDED <br />by Commissioner Stanbridge, the Board <br />unanimously approved the Memorandum of <br />Understanding with the USDA Natural Resources <br />Conservation Service, as recommended by staff. <br />MEMORANDUM IS ON FILE IN THE <br />OFFICE OF THE CLERK TO THE BOARD <br />APRIL 189 2000 <br />BOOK L3 PAGE 105 <br />-13- <br />
