The amount of this `original" performance bond covers only <br />a portion of what is now required to be installed within the Jungle Trail buffer. However, the <br />developer is also posting additional security for additional Jungle Trail buffer work, as described later <br />in this report, and to guarantee the survival and health of the 5 large live oaks. No. SD -99 -07 -10 -AA <br />Performance bond, guaranteed by a Florida <br />surety, for contract No. SD -99 -07 -10 -AA. <br />Covers additional Jungle Trail buffer <br />plantings in accordance with revised <br />buffer plan dated April 25, 2000. <br />Obligates developer to complete <br />additional plantings on or before July <br />1, 2000. <br />3. No. SD -99 -07 -10 -LO <br />Letter of Credit to support contract No. SD -99- <br />07 -10 -LO to run until May 2, 2006. <br />Covers installation and monitoring <br />viability of the 5 large live oaks. <br />Obligates developer to have live oaks <br />installed on or before May 2, 2001 and <br />to monitor the viability of the trees <br />until May 2, 2006. <br />These contract, bond, and letter of credit forms were devised by and approved by the County <br />Attorney's Office. <br />Based upon landscaping amounts covered by both bonds, Environmental Planning staff are satisfied <br />that the proposed tree replacement and Jungle Trail buffer work are adequately secured. The county <br />attorney's office has approved the construction contracts for legal form and sufficiency and has <br />approved the format of the performance bonds and letter of credit. <br />All applicable requirements regarding final plat approval have been satisfied regarding standard <br />infrastructure and platting matters. Jungle Trail buffer issues relating to final plat approval are <br />discussed later in this report. Pursuant to the county's LDRs, the applicant will be required to obtain <br />a certificate of completion after satisfactory completion of the required improvements. At that time, <br />the applicant will warranty the utility improvements via a utility services department Bill of Sale. All <br />other improvements will be privately dedicated; therefore, no warranty maintenance agreement is <br />required. <br />May 2, 2000 <br />74 <br />
