Memo from Attorney's Office and Information Received from an Independent Horticultural <br />Consultant <br />Planning Director Stan Boling reviewed the memorandum using a site map depicting <br />the area projected on the overhead screen. He highlighted the actions taken by the developer <br />to resolve the tree removal/land clearing violations and related final plat issues. <br />Deputy County Attorney Will Collins explained the contracts the developer will <br />sign, the significance of each one, and how the documents had changed due to the improper <br />landscape clearing. He explained the terms of the Letter of Credit in the amount of $100,000 <br />and the County's protection. He also advised that the County had contacted an independent <br />horticulturist, Gary Doyle, who was present to answer questions if needed. Mr. Doyle <br />has advised that typically whether a plant or tree would survive will be known within a year, <br />but to be safe a three to five year observation period would suffice. Mr. Doyle also gave <br />advice as to the timing between root pruning and planting which has been incorporated into <br />the contract. The live oak contract requires Beazer to install the live oaks within a year from <br />this date. We have been told the root pruning is most effective in November and we would <br />expect them to be installed around February. After the agenda went out, Beazer requested <br />that the contract be clarified to provide for a 60 -month monitoring period from the date of <br />May 2, 2000 <br />76 <br />
