r <br />BOOK hJ PAGEW511 <br />On February 6, 1987 Ms. Clark filed suit against the County Building Official, <br />Ester Rymer (Case No. 870064-CA18), however the case was dismissed on <br />October 11, 1988 for failure to prosecute. <br />On July 7, 1987 the Board of County Commissioners authorized the recordation <br />of a demolition lien in the principal amount of $2,956.26 against the owner, <br />Katherine M. Clark, and Lot 19, Block 3, Smith Plaza Subdivision. The lien was <br />subsequently recorded on July 20, 1987 in O.R. Book 0773 at Page 2831 of the <br />Public Records of Indian River County, and bears interest at the rate of 12% per <br />annum from the date of recording until the total amount, including interest, is <br />paid. As of this writing, the payoff figure is $7,519.79. <br />On February 28, 1993, Ms. Clark died as a result of a shooting incident. <br />On May 17, 2000 this office received a request from First American Titre for a <br />payoff figure on the demolition lien due to a pending sale of the property. The <br />title company indicated that the title to the property was in the name of the Estate <br />of Katherine M. Clark, and that the property was being sold for $4,000. An <br />estoppel letter was prepared and sent to the title company. <br />Katherine Clark's mother, Odessa Clark, is now protesting the lien and its <br />accrued interest. <br />Odessa Clark, 4776 34' Avenue, stated that she owns the property on 33'd Avenue <br />and that the house had been demolished by the County. She was not aware there was a lien <br />for the demolition charges attached to the property until she had sold the property. <br />Acting County Attorney Terry O'Brien explained that the structure was found to be <br />unsafe and was demolished by the County after notice to the property owner was ignored. <br />The lien must be paid off when the property changes hands. The original lien was slightly <br />under $3,000 in 1987, while the current payoff is now approximately $7,500, including <br />interest at 12% per annum. <br />Chairman Adams inquired whether the property had sold for $4,000, and Ms. Clark <br />responded in the affirmative. <br />JUNE 69 2000 <br />-48- <br />_I <br />
