Kafer, Jr., P.E., County Engin v <br />SUBJECT: Award of Bid No. 2037 — South County Park provements, Phase 2, IRC <br />Project No. 9624 <br />DATE: May 31, 2000 <br />DESCRIPTION AND CONDITIONS <br />This item was submitted to the Board of County Commissioners at the regular meeting of May 2, <br />2000 and was tabled due to information being submitted late. It then was brought back to the Board <br />of County Commissioners at the regular meeting of May 16, 2000. At that meeting, the Board <br />determined it was in the best interest of the County to award the bid in accordance with procedures <br />established by ordinance prior to July 1, 1994, as allowed under Section 255.20 (1)(a)(10), F.S. (see <br />enclosed memorandum from Terrence P. O'Brien, Acting County Attorney, dated May 24, 2000). <br />There are two issues with the awarding of this bid as follows: <br />1. Adnan Investment & Development, Inc. was the low bidder by $661.42 after corrections to all <br />bids (Adnan Investment & Development, Inc. had an error in their bid of $44,604.00). <br />Staff requested a listing of references from Mr. Adnan Alghita, President of Adnan Investment <br />& Development, Inc., which he provided to us. We called those references and received <br />responses that staff considered to be unfavorable. Therefore, staff recommends the second low <br />bidder, which is Barth Construction, Inc., be awarded the contract. <br />2. Summit Construction Management, Inc. wrote a letter to Christopher J. Kafer, Jr., P.E., County <br />Engineer, dated April 28, 2000, contending that Barth Construction, Inc. did not submit an <br />acknowledgment form for Addendum No. 3. I responded to that letter in a memorandum to <br />James Chandler, dated May 3, 2000, basically stating that Addendum No. 3 was a clarification <br />to questions received from contractors and that it is in the best interest of the County to accept <br />the bid from Barth Construction, Inc. as a valid bid for this project. (A copy of both letters is <br />enclosed.) <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends that the bid be awarded to the second lowest bidder, Barth Construction, Inc. <br />Staff feels that approval of Barth Construction, Inc. bid is in the best interest of Indian River County. <br />In addition, staff requests the Board of County Commissioners approve the attached agreement when <br />requirements are met and approved as to form by the County Attorney. <br />The County budget for the project is $662,295.00. Funding is from Account No. 315-210-572- <br />068.05. Funds will be available through Local Option Sales Tax. Also, there is a $100,000.00 <br />Florida Department of Environmental protection FRDAP (Florida Recreation Development <br />Assistance Program) funded for this project..' <br />JUNE 69 2000 <br />• <br />-60- <br />• <br />
