• <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of June 20, 2000. <br />DESCRIPTION AND CONDITIONS: <br />The subject project was approved on August 12, 1999 by the Planning and Zoning Commission as <br />Arbor Trace Phase I PD. The total project is a two phase 71.92 acre single-family planned <br />development subdivision containing 148 lots. located on the west side of 43id Avenue between 5' <br />Street SW and Oslo Road. The subject site is zoned RS -3, Residential Single Family (up to 3 units <br />per acre), and is being developed at a density of 2.16 units per acre. Arbor Trace Phase I contains <br />87 lots, recreation tracts, road rights-of-way, stormwater tracts, and future development tracts. The <br />future development tracts will be platted in the future as Phase 2 single family lots. The proposed <br />Phase 1 final plat is in conformance with the approved conceptual plan and the approved preliminary <br />PD plan/plat. <br />At its regular meeting of September 7. 1999, the Board of County Commissioners granted planned <br />development special exception use approval for the overall project. The Board's action made <br />effective the two phase preliminary PD plat approved by the Planning and Zoning Commission. <br />Subsequently, a land development permit was issued for construction of the improvements required <br />to serve the proposed planned development. Because construction of required improvements (i.e. <br />roadways, stormwater management, utilities) has not been completed at this time, the developer is <br />proposing to "bond -out" to guarantee the satisfactory completion of the remaining work to be <br />performed. The applicant, Oak Trace Development. through its agent Triad International <br />Consultants, is now requesting final plat approval for Arbor Trace and has submitted the following: <br />1. A final plat in conformance with the approved conceptual and preliminary PD plan/plat-, <br />=. A Contract for Construction of the remaining required subdivision improvements. <br />3. An Engineer's Certified Cost Estimate for completion of the remaining required subdivision <br />improvements; <br />ANALYSIS: <br />Not all of the required subdivision improvements have been completed as of this date (i.e. <br />landscaping buffers, roadways, stormwater management, and utility services). However, the <br />developer desires to proceed with recording the plat and proposes to "bond -out" for construction of <br />the remaining required on-site improvements pursuant to the provisions of subdivision ordinance <br />section 913.10. An itemized certified engineer's cost estimate for completion of the remaining <br />improvements has been reviewed and approved by the Public Works Department, Utilities Services <br />Department, and the Community Development Department. The developer has submitted a contract <br />for construction of required improvements. The County Attorney's Office has approved the format <br />of the letter of credit. The original letter of credit will need to be submitted to the County Attorney's <br />Office prior to the County Attorney signing the mylar. The contract. which is on a standard form <br />approved by the County Attorney's Office, requires all improvements to be completed within one <br />year. With those documents, the developer has complied with the appropriate requirements to <br />obtain final plat approval. <br />Platting will allow lot sales and construction of single family homes.
