Community Development Director Robert Keating reviewed the Comp Plan <br />amendment process, advising that this is the first public hearing before the Board of County <br />Commissioners on this amendment request. If the Board approves the transmittal of this <br />application to the Department of Community Affairs (DCA) in Tallahassee for their 60 -day <br />review, a second and final public hearing will be scheduled to consider any comments made <br />by the DCA and whether to adopt an ordinance amending the Comp Plan. If the Board <br />denies the transmittal of an application to the DCA, the application process will come to an <br />end. <br />Director Keating noted there is a significant buffer in the main relief canal which is <br />300 feet wide. <br />Attorney Michael O'Haire, representing the applicant, stated that Gerald Clontz has <br />lived on this property all his life. His father planted the grove that is there now. However, <br />due to surrounding development, the property can no longer be used for agricultural <br />purposes. The Department of Environmental Protection will not allow overspraying. Ruby <br />Tuesday's is immediately to the north of his property on a 4 -lane highway with a built -out <br />node across the highway. Mr. Clontz cannot farm or live on his property any longer. This <br />is now prime development property and Mr. Clontz is entitled to some relief. <br />Chairman Adams felt this is an unusual situation and exemplifies the problem of <br />interfacing agricultural uses with commercial development. <br />The Chairman opened the public hearing and asked if anyone wished to be heard <br />regarding this matter. <br />JULY 119 2000 <br />-133- <br />BK 114 PG 14 9 <br />
