• <br />ORDINANCE NO. 2000- 021 <br />Commencing at the northeast comer of the southwest 1/4 of the southwest 1/4 of <br />Section 23, Township 31 South, Range 38 East, Run North 89°5345" west a distance <br />of 958.24 feet; then run south 0009149" east a distance of 43.62 feet to the point of <br />beginning of the following described parcel; then continue south OOo09'49" east a <br />distance of 205.37 feet; then run north 89050'11" east a distance of 126.36 feet; then <br />run north 0049'49" west a distance of 229.49 feet to the southerly right-of-way of <br />State Road 512, then run along state road 512 right-of-way along a non -radial curve <br />concave to the northwest, having an arc length of 128.66 feet, a radius of 2,060.00 <br />feet and an arc angle of 03°3443", a chord bearing of south 79°01'40" west and a <br />chord distance of 128.64 feet to the point of beginning. Containing 0.63 acres more <br />or less. <br />is changed from L-1, Low -Density Residential-1(up to 3 units/acre), to C/I, Commercial/Industrial, <br />and the Future Land Use Map is hereby revised accordingly. <br />SECTION 3. Rpeal of Conflicting Provisions <br />All previous ordinances, resolutions, or motions of the Board of County Commissioners of <br />Indian River County, Florida which conflict with the provisions of this ordinance are hereby repealed <br />to the extent of such conflict <br />SECTION 4. Ceverability <br />It is declared to be the intent of the Board of County Commissioners that if any provision of <br />this ordinance and therefore, the Indian River County Comprehensive Plan Amendment is for any <br />reason finally held invalid or unconstitutional by any court of competent jurisdiction, such provision <br />shall be deemed a separate, distinct and independent provision and such holding shall not affect the <br />validity of the remaining provisions. <br />SECTION 5. Pffective Date <br />Unless challenged, the effective date of this ordinance, and therefore, this plan amendment, <br />shall be August 11, 2000. If challenged, the effective date of this ordinance, and therefore, this plan <br />amendment, shall be the date a final order is issued by the Department of Community Affairs or <br />Administration Commission finding the amendment in compliance with Section 163.3184, Florida <br />Statutes, whichever occurs earlier. <br />This ordinance was advertised in the Press -Journal on the 7s' day of June, 2000, for a public <br />hearing to be held on the 2e day of June, 2000, at which time the Board of County Commissioners <br />voted 4 to 0 to continue the public hearing on July 11, 2000, at which time it was moved for <br />adoption by Commissioner Ti ppi n , seconded by Commissioner Macht , <br />and adopted by the following vote: <br />JULY 119 2000 <br />-77- <br />KK 114 PG 093 <br />• <br />I <br />
