Collins II, Deputy County Attorney <br />DATE: INS July 24, 2000 <br />SUBJECT: Children's Home Society Land Parcel Located on Oslo Road <br />1. In 1991 the Board of County Commissioners deeded the subject parcel to the <br />Children's Home Society of Florida and the Society paid the County $25,000. The <br />County Deed contained a condition that the Society would build and maintain a <br />shelter for runaway children within a certain period of time. No shelter was built on <br />the subject parcel. <br />2. In 1995 the Board granted a five-year extension to the Society. At that time a <br />modified conveyance was provided stating that should the Society fail to build within <br />the extended time period the County could record a resolution declaring a failure of a <br />condition of the conveyance of the property, return the $25,000 within ten days of <br />recording, and the property would revert to the County. <br />3. In July of 1999 the Board approved the Society's request to sell the subject parcel <br />with the County being given the right of first refusal should the Public Works <br />Department need the parcel for storm -water retention. No action was ever taken to <br />implement that action. <br />4. The Public Works Department has determined that the parcel is necessary for Oslo <br />Road storm -water retention. On March 21, 2000, the Board approved exercising the <br />County's rights under the modified deed to pay the Society $25,000 and retake <br />possession of the parcel. <br />We have been advised that a representative of the Children's Home Society would like <br />to appear and speak at the Board of County Commissioners' meeting today. <br />Recommendation: Adopt and record the attached resolution and arrange payment <br />of the $25,000 to the Children's Home Society within ten days of recording. <br />Attachment: Resolution <br />August 1, 2000 <br />97 <br />BK 114 PG 437 <br />
