ANALYSIS: <br />Staffs position is that the airport noise impact zone boundaries not be changed because: <br />there is no technical information available to justify a change <br />a change in the noise impact zone boundary would not affect existing residences <br />When the County enacted its airport zoning regulations several years ago, the airport noise impact <br />zone boundaries were established The zone boundaries were set based on federal FAA requirements <br />for airports, bice the Vero Beach Airport, which have not conducted a Part 150 noise study. <br />Since the noise impact boundaries were established using acceptable FAA methodology, those <br />boundaries could be changed only by applying the same methodology or based on the results of a <br />Part 150 study. Because a Part 150 study has not yet been undertaken for the Vero Beach Airport, <br />staffs position is that no technical data are available to change the existing noise impact zone <br />boundaries. <br />Regardless of the location of the airport noise impact zone boundary, it is important to consider the <br />regulation effect of the noise impact zone. As adopted, the County's airport zoning provisions, <br />Section 911.17 of the County's I:.DRs, regulate only new construction within the noise impact zone. <br />The noise zone boundaries do not affect existing development. <br />Within noire impact zones, certain uses are permitted, some are allowed with conditions, and some <br />are prohibited. Among those uses which are allowed with conditions are residential developments. <br />For residential development within noise impact zones, the conditions are that residential structures <br />be constructed so that the structures meet established noise level reduction standards (these standards <br />are met by residential construction throughout the County because of existing building/energy code <br />requirements), or alternatively (instead of meeting noise level reduction standards) a property owner <br />may execute an avigation easement to the airport, acknowledging that the airport will continue to <br />produce noise and not be a nuisance. <br />As indicated above, there is no technical information which would justify changing the existing Vero <br />Beach airport noise impact zone boundary. Also, changing the boundary would not have any effect <br />on existing residences within a noise impact zone. For those reasons, staff recommends that no <br />action be taken by the Board of County Commissioners regarding the County's airport noise impact <br />zone boundaries. <br />RECOMMENDATION: <br />Staff recommends that no action be taken on the County's airport noise impact zone boundaries. <br />October 17, 2000 <br />52 <br />
