Keating, AICP <br />Community Development Director / <br />FROM: Stan BolinA-6 <br />Planning Director <br />DATE: October 17, 2000 <br />SUBJECT: First Hearing: Proposed LDR Amendment on Rooster Regulations <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its meeting of October 24, 2000. <br />BACKGROUND: <br />Over the past two years, the county has received and acted on several complaints involving a rooster <br />(game fowl) breeding/raising operation conducted by Mr. Willis Wilson that was initially conducted <br />in the Roseland area on a residentially zoned site. Within the last year, the use was moved to an <br />agriculturally zoned site in the Fellsmere area. <br />Staff's interpretation of the existing LDRs is that county regulations allow the raising of game fowl <br />in agricultural areas. This interpretation is based on a determination that such a use is similar to <br />"poultry raising", which is a permitted "by right" agricultural use. Subsequent to staff s rooster use <br />determination, residents living near the Fellsmere area location of the game fowl operation appealed <br />staff s determination to the Planning and Zoning Commission. <br />At its August 10, 2000 meeting, the Planning and Zoning Commission overturned staffs decision <br />and determined that a game fowl operation is more similar to a "small animal specialty farm" use <br />OCTOBER 24, 2000 <br />-67- <br />
