Director Boling reviewed the criteria to be considered in this appeal and staff's <br />recommendation. <br />Michael O'Haire, attorney representing the appellant, stressed that "project site" is <br />a defined term under 901.03 in the LDR's and a key factor in this matter. He described in <br />detail the location of Mr. Godfrey's property as to roadways, zoning, and other topographical <br />characteristics of the surrounding properties. He advised of Mr. Godfrey's plans to mine the <br />38 -acre property, create a lake for water retention, and to build his future home there. He <br />chronicled all Mr. Godfrey's attempts to establish a route for hauling dirt including hiring <br />Randy Mosby to plat his property. He argued that information presented by staff <br />misrepresented the real situation. He stated the "project site" does not consist of two areas, <br />but the excavated site on the site plan and a 1 00'perimeter around the excavation. When Mr. <br />Godfrey leaves a 100' perimeter around the pit, he has left the project site under the land <br />development regulations, but even if that were not the case, when he crosses his property line <br />and enters the property of the FWCD and then over to a third area of ownership, he is clearly <br />off his sand mining site. He presented various documents for the record including minutes <br />from the Fellsmere City Council meeting. (Clerk did not receive these at the meeting, but has <br />requested same from Mr. O'Haire's office.) He believed one of the City's consent agenda <br />items was outside the Sunshine and outside the jurisdiction of the City. He then questioned <br />the wisdom of the pertinent LDR's relative to use of Babcock. This appeal was based on <br />improper consideration by the PZC because the members were not provided with the <br />definition of "project site" from the LDR's. He asked the Board to reverse their decision and <br />find that they had acted on incomplete information. He believed Mr. Godfrey and other <br />property owners should be able to rely on the LDR's. He stressed that no part of Mr. <br />Godfrey's property was within the city limits of Fellsmere and, therefore, the City had no <br />jurisdiction in this matter. <br />November 7, 2000 <br />170 <br />BK 1 15 PG 879 <br />
