DeBlois�AIICCP <br />Chief, Environmental Planning <br />& Code Enforcement <br />FROM: Kelly Zedek <br />Code Enforcement Officer <br />DATE: 10/17/2000 <br />RE: PIERRE RAYMOND REQUEST FOR PARTIAL RELEASE OF EASEMENT <br />AT 7425 30TH COURT (COPELANDS LANDING SUB PHASE In <br />It is requested that the data herein presented be given formal consideration by the Board of County <br />Commissioners at its regular meeting of November 7, 2000. <br />DESCRIPTION AND CONDITIONS <br />The County has been petitioned by PIERRE RAYMOND, owner of a lot at 7425 30th Court, for <br />partial release of a thirty-one foot wide rear yard drainage easement on the lot. The purpose of the <br />easement release request is to allow for construction of a stemwall and pool for a single family <br />home (see attached map). <br />ALTERNATIVES AND ANALYSIS <br />The request has been reviewed by Bell South Communications: Florida Power & Light Corporation: <br />T.C.I. Cable Corporation: the Indian River County Utilities Department: the County Road & Bridge <br />and Engineering Divisions; the County surveyor, and the Copelands Landing Property Owners <br />Association. Reviewing utility providers have no objection to the proposed partial easement release, <br />under the condition that there be no construction beyond the proposed stemwall, due to an <br />underdrain that exists in the easement (west of the easement portion proposed for release). Since <br />the underdrain is in the portion of the easement that is not proposed to be released for construction, <br />it is staff's position that the requested easement release would have no adverse impact to utilities <br />being supplied to the subject properties or to other properties. <br />RECOMMENDATION <br />Staff recommends that the Board, through adoption of the attached resolution, release the eastern <br />nine feet of the thirty-one foot wide rear yard drainage easement at 7425 30th Court, as more <br />particularly described in said resolution. <br />ATTACHMENTS <br />1.
