E. A written grievance must set forth the following: <br />1. A complete statement of the grievance and the facts upon which it is <br />based; <br />2. The section or sections of this agreement claimed to have been violated; <br />and <br />3. The remedy or correction requested. <br />F. The Union will be notified of any grievances filed by its bargaining unit <br />employees. <br />In the settlement of any grievance resulting in retroactive adjustment, such adjustment shall <br />be limited to 180 calendar days prior to the date of the filing of the grievance. <br />Bargaining unit employees cannot use the District's or County's grievance or appeal <br />procedures for any claims falling within the definition of a grievance herein. <br />STEPS FOR GRIEVANCE PROCESSING <br />If a grievance arises, the grievant must meet with and discuss the grievance with the Battalion Chief <br />in charge of the shift within ten working days of the event giving rise to the grievance. If the <br />grievant does not have a Battalion Chief, then the grievant is to proceed to Step 1. If the grievant <br />does not have an Assistant Chief, then the grievant is to proceed to Step 2 within 10 working days of <br />the event giving rise to the grievance. In the event the issue in dispute cannot be resolved between <br />the supervisor and the grievant, the grievance shall be presented in writing by the grievant at Step 1 <br />(or applicable Step as outlined above) of the grievance procedure within five working days from the <br />date of the supervisory meeting. Such written grievance must indicate that the matter had been <br />reviewed with the immediate supervisor. <br />Step 1: The grievant shall present the written grievance to the Assistant Chief. The Assistant Chief <br />shall meet with the grievant, which a union steward or a union representative may <br />accompany if the union is not the grievant. The Assistant Chief shall reach a decision and <br />communicate it in writing to the grievant with a copy to the union if it is not the grievant <br />17 <br />
