Community Development Director Stan Boling recalled the Board's <br />adoption on October 21, 2014 of Ordinance 2014-018, amending Chapter <br />315 (Pain Management Clinics) to add regulations for Medical Marijuana <br />Treatment Centers, in preparation for the possible passage of Amendment <br />2, "Use of Marijuana for Certain Medical Conditions." He reported that <br />on November 4, 2014, the Board held its first public hearing regarding <br />proposed amendments to Land Development Regulations (LDRs) to <br />regulate Medical Marijuana Treatment Center locations and operations, <br />and that this is the final public hearing for the proposed LDR amendments. <br />Director Boling said that since Amendment 2 did not pass, staff <br />recommends that the Board reject the proposed Ordinance and authorize <br />the County Attorney to repeal Ordinance 2014-018. <br />Commissioner O'Bryan recommended that the County have Ordinance <br />2014-018 and the proposed LDR amendments in place, in case Amendment <br />2 (or a similar initiative) resurfaces and becomes law. <br />Commissioner Flescher felt that the regulations could be reactivated at any <br />time. <br />Chairman Davis felt that if the regulations on medical marijuana were <br />already in place, citizens might be more inclined to vote for future medical <br />marijuana initiatives. <br />Vice Chairman Solari suggested that the Board keep current on this <br />matter and be ready to respond quickly to new developments. <br />The Chairman opened the Public Hearing. <br />There were no speakers, and the Chairman closed the Public Hearing. <br />ON MOTION by Vice Chairman Solari, SECONDED by Commissioner <br />Flescher, the Board unanimously: (1) rejected the proposed Land <br />Development Regulation amendment; (2) authorized the County Attorney <br />to initiate the process for repealing Ordinance No. 2014-018; and (3) <br />directed the County Attorney/staff to keep abreast of any movement on the <br />medical marijuana initiative. <br />(Clerk's Notice: the Chairman declared the meeting adjourned at 5:11 p.in.; <br />however, County Administrator Joseph Baird interjected that he had an <br />urgent matter to discuss with the Board). <br />Administrator Baird relayed that he had just received a telephone call from <br />St. Lucie County Administrator Howard Tipton requesting a joint meeting <br />between the St. Lucie and Indian River County Commissions on All <br />Aboard Florida. <br />Special Call Public Hearing <br />November 18, 2014 Page 2 <br />
