r <br />an unreasonable obstruction to the free navigation of the said Indian River (a navigable water; <br />;way of the United States), due to hazards to navigation,faulty location, sad inadequate horizon- <br />I;tal clearance through the drawspan,of said bridge; and <br />SAS the said bridge is awned by the County of Indian liver, Florida; add <br />WHEREAS a public hearing was held at Vero Beach, Florida' on May 1, 19469 in conform- <br />ity with the provisions of Section 18 of the River and Harbor Act of March 3, 1899 (30 Stat. <br />1;1153; 33'.'S.C. 502)f upon due notice given Indian River County amd all other parties in <br />Interest; and <br />WHEREAS i <br />the testimony adduced and the facts presented at said hearing, have been duly <br />!,,considered by the Secretary of War and the Chief of Engineers; and i <br />WHWAS the following changes in said bridge have been recommended by the Chief of <br />Engineers as necessary to render navigation through or under said bridge reasonably free, easy <br />;and unobstructed, to wits <br />(a) Removal of the existing drawspan, pivot pier, both rest piers' fender systems ail <br />any other parts of the bridge, including all broken piles and stubs, down to the natural bot om "' <br />!'of the waterway for a distance of 142 feet easterly and 185 feet westerly from the center of the <br />i pivot pier' and that the work of the removal of these parts of the bridge be commenced within <br />:two months from the date of service of this order and fully completed within five months from <br />said date. <br />(b) Removal of all parts of the existing bridge not included in subparagraph; (a) <br />:above, from the highwater shore lane at the mainland to the high-water shore line at the west <br />;side of the barrier beach, down to the natural bottom of the waterway' the work of removal to <br />lbe commenced within one year from the date of service of this orders and be completed within <br />two years from said dates Provided' however, that if it is found that the work of dredging the <br />°proposed realigned channel of the Intracoastal Waterway is to be commenced prior to the time <br />'specified for complete removal of the bridge, a supplemental order will be issued requiring the <br />owner to remove all remaining parts of the structure for a distance of 150 feet on each side of <br />,'the center line of the relocated channel, such work of removal to be comm6nesed within two <br />;:months from the date of service of such supplemental order and completed within five months <br />,;months <br />date thereof, the original order to remain otherwise in full force and effect. <br />NOW WE, In obedience to and by virtue of the provisions of Section 18 of the <br />'Act of Congress of March 39 1899 the Secretary of War, having first given the parties fu41 <br />,opportunity to offer evidence and be heard' as required by that section, does hereby notify, <br />Ithe Board of County Commissioners of the County of Indian Rivers Vero, Florida, to make the <br />lal terations in said bridge as described above. <br />ii <br />Robert P. E. Carters County Engineer, was, authorized and instructed to follow orders -and/or <br />lAnstructions from the War Department with regard to the removal of the Winter Beach bridge.with <br />'the understanding that any salvage from said bridge be used for public roads and bridges within <br />the boundaries of the Winter Beach Bridge district. <br />April 4, 1947 <br />i <br />,Hon.
