The Department <br />and the Recipient are sometimes referred to in this Agreement as a "Party"' and collectively as <br />the "Parties". <br />RECITALS <br />A. The Department is authorized under Section 334.044 (7), Florida Statutes, and Section <br />339.2818, Florida Statutes to enter into this Agreement. <br />B. WHEREAS, the Small County Outreach Program ("SCOP") has been created within the <br />Department pursuant to Section 339.2818, Florida Statutes, to provide funds to counties to <br />assist small counties in resurfacing or reconstructing county roads or in constructing capacity <br />or safety improvements to county roads and also to municipalities within rural areas of critical <br />concern (rural area of opportunity ("RAO")) with projects, excluding capacity improvement <br />projects. <br />C. The Department has determined that the transportation project described in Exhibit "A" <br />attached and incorporated in this Agreement ("Project"), is necessary to facilitate the <br />economic development and growth of the State and the Department is authorized by Section <br />339.2821, Florida Statutes, to approve and expenditure to the Recipient for the direct cost of <br />the Project. <br />D. Exhibits A, B, C, D, and E are attached hereto and incorporated by reference into this <br />Agreement. <br />E. The Recipient is authorized to enter into this Agreement by the resolution attached and made <br />part of this Agreement as Exhibit E. <br />NOW, THEREFORE, in consideration of the mutual benefits contained in this Agreement, <br />the parties agree as follows: <br />
