Florida Statutes: <br />334.044(7) <br />850-035-01 <br />PAVEMENT MANAGEMENT <br />OGC — 02115 <br />Page 9 of 21 <br />Failure by the Recipient to grant such public access shall be grounds for immediate <br />unilateral cancellation of this Agreement by the Department. The Recipient shall promptly <br />provide the Department with a copy of any request to inspect or copy public records in <br />possession of the Recipient and shall promptly provide the Department a copy of the <br />Recipient's response to each such request. <br />11. The Recipient shall comply with all federal, state and local laws and ordinances applicable <br />to the work or payment for work thereof, and shall not discriminate on the grounds of race, <br />color, religion, sex, or national origin in the performance of work under this Agreement. <br />12. The work performed pursuant to this Agreement may require authorization under the <br />Clean Water Act, by the U.S. Environmental Protection Agency for Storm Water <br />Discharges from construction sites. The Recipient is responsible for obtaining the <br />National Pollutant Discharge Elimination System Permit and all other necessary permits <br />for construction of the Project. When applicable, such permits will be processed in the <br />name of the Department; however, in such event, the Recipient will comply with all terms <br />and conditions of such permit in construction of the subject facilities. <br />13. The Recipient affirms that it is aware of the provisions of Section 287.133(2)(a), Florida <br />Statutes. A person or affiliate who has been placed on the convicted vendor list following <br />a conviction for a public entity crime may not submit a bid on a contract to provide any <br />goods or services to a public entity; may not submit a bid on a contract with a public <br />entity for the construction or repair of a public building or public work; may not submit <br />bids on leases of real property to a public entity; may not be awarded or perform work as <br />a contractor; supplier, subcontractor or consultant under a contract with any public entity; <br />and may not transact business with any public entity in excess of the threshold amount <br />provided in Section 287.017, Florida Statutes, for CATEGORY TWO for a period of thirty <br />six (36) months from the date of being placed on the convicted vendor list. The Recipient <br />agrees that it shall not violate Section 287.133(2)(a), Florida Statutes, and further <br />acknowledges and agrees that any conviction during the term of this Agreement may <br />result in the termination of this Agreement. <br />14. The Department shall consider the employment by any contractor of unauthorized aliens <br />a violation of Section 274A(e) of the Immigration and Nationality Act. If the Recipient <br />knowingly employs unauthorized aliens, such violation shall be cause for unilateral <br />cancellation of this Agreement. <br />15. The Recipient will not discriminate against any employee employed in the performance of <br />this Agreement, or against any applicant for employment because of age, ethnicity, race, <br />religious belief, disability, national origin, or sex. The Recipient shall provide a harassment - <br />free workplace, with any allegation of harassment given priority attention and action by <br />management. The Recipient shall insert similar provisions in all contracts and subcontracts <br />for services by this Agreement. The Recipient affirms that it is aware of the provisions of <br />
