ARTICLE 19 - SHIFT EXCHANGE <br />The current language in Article 19 - Shift Exchange has been existence for decades, is consistent <br />with the Fair Labor Standards Act, and is consistent with regulations and opinions interpreting the <br />Fair Labor Standards Act. The Union's position is that the current language should remain as is. <br />Again, it is very important to understand that, in working 24 hours on -duty followed by 48 hours off- <br />duty, shift employees are scheduled for an average work week of 56 hours or, alternatively stated, <br />shift employees are scheduled to either work 48 hours per week or 72 hours per week. That is <br />scheduled time, before overtime. Overtime is pervasive and even one overtime shift would place <br />shift employees at either 72 hours for the week or 96 hours for the week. Throughout negotiations, <br />the Union had indicated it could compromise and change certain aspects of Article 19 - Shift <br />Exchange, as long as the new restrictions did not apply to shift employees performing Union <br />business, or charity work such as the Fair, or education. The Union made is absolutely clear that, <br />if proposed restrictions were going to apply to Union representatives, then it would have to have <br />some type of Union Business Bank or the status quo should be maintained. The County <br />Administrator's position never changed. <br />Your shift employees work the longest hours with the least time off than any department in the local <br />operating area selected by your Director. In the absence of the Union Business Bank, the status quo <br />must be maintained. <br />Local 2201 respectfully requests that a motion be made to adopt the Union's proposal for Article 19 - <br />Shift Exchange which immediately follows on the next page. <br />
