DeBraal, Deputy County Attorney <br />Kate Pingolt Cotner, Assistant County Attorney <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney 0(1. -- <br />DATE: March 25, 2015 <br />SUBJECT: City of Vero Beach -Indian River Shores -Indian River County Mediation Update <br />BACKGROUND. <br />On December 17, 2014, representatives from Indian River County (the "County"), the Town of Indian <br />River Shores (the "Town") and the City of Vero Beach (the "City") attended a mediation under the <br />Florida Governmental Conflict Resolution process as set forth in Chapter 164 of the Florida Statutes. As a <br />result of the mediation, the representatives agreed to an Interim Mediation Agreement, which was <br />approved by the governing bodies of the County, City and Town. <br />On February 26, 2015, the Town voted to continue the mediation process under the terms of the Interim <br />Mediation Agreement and conduct another mediation session. The Town voted to continue to abate its <br />lawsuit until May 15th and seek to set the next mediation session around May 1st. On March 10, 2015, the <br />Board of County Commissioners voted to continue to participate in the Florida Governmental Conflict <br />Resolution process under the terms of the Interim Mediation Agreement. <br />Carlos Alvarez, the mediator at the December 17, 2014 mediation recently informed counsel for all three <br />entities that he is available for a mediation session on Friday, May 1, 2015 at 9:00 a.m. Both the Town <br />and the City have indicated that they are available to attend the mediation session on that date. The Town <br />has offered the use of the Town's Community Center located at 6001 North Highway Al A, Indian River <br />Shores, FL 32963 for the mediation.
