DeBraal, Deputy County Attorney <br />Kate Pingolt Cotner, Assistant County Attorney <br />MEMORANDUM <br />TO: Board of County Commissioners <br />FROM: Dylan Reingold, County Attorney <br />DATE: April 6, 2015 <br />SUBJECT: Interlocal Agreement with City of Vero Beach on Dodgertown Golf Course <br />BACKGROUND <br />In 2005, the City of Vero Beach (the "City") purchased 37+/- acres of real property commonly known as <br />the former Dodgertown nine -hole golf course (the "City Property"). At that time, the City, Los Angeles <br />Dodgers, LLC (the "Dodgers") and DT Commons, LLC executed a Second Amendment to the Collateral <br />Development Agreement (the "Second Amendment"), which provided that the City shall develop the City <br />Property solely as (i) a municipally -owned public golf course, or (ii) green space, or (iii) park -like setting, <br />or (iv) any combination of the foregoing three uses (the "Use Restrictions"). The City and the Dodgers <br />also executed a Declaration of Covenants, Conditions, and Restrictions, limiting the City's use of the City <br />Property to the Use Restrictions as stated in the Second Amendment. Under the Second Amendment, the <br />City could not develop and/or permit the use of the City Property for any other use or purpose whatsoever <br />without the prior written consent of both the Dodgers and Indian River County (the "County"). In <br />February 2008, Indian River County succeeded to all interests of the Dodgers in the Second Amendment <br />and the Declaration of Covenants, Conditions, and Restrictions. <br />APPROVED FOR APRIL 14, 2015 <br />B.C.C.
