(Clerk's Note: This item was heard following Item 12.C.1.b. and is placed <br />here for continuity). <br />Ellen Schaeffer stated that in 2007, Congress designated Ft. Pierce as the <br />official site of the National Navy UDT-Seal Museum. <br />Rick Kaiser, Retired Master Chief Navy Seal, and Executive Director <br />Navy UTD-Seal Museum, explained the mission of the Museum, and <br />thanked the Board for its support. <br />Craig Mundt, Vice President, Board of Directors, National Navy UDT- <br />Seal Museum, relayed that over $3 million of improvements have <br />recently been made to the museum, and they are looking to expand <br />further. He also disclosed that the Museum is getting support at the <br />State level. <br />ON MOTION by Vice Chairman Solari, SECONDED by Commissioner <br />Zorc, the Board unanimously approved Resolution 2015-041, urging the <br />Florida Legislature and the Governor Rick Scott to support keeping the <br />National Navy UDT-Seal Museum in Ft. Pierce, Florida. <br />11:44 C. Potential Lawsuit Challenging U.S. Department of Transportation's <br />a.m. Approval of the Issuance of $1,750,000,000 of Tax Exempt Private Activity <br />Bonds for All Aboard Florida <br />(memorandum dated March 11, 2015) <br />County Attorney Dylan Reingold recalled actions taken by the Board on <br />February 17, 2015 and March 3, 2015, to: (1) approve the appropriation <br />of funding to protect the County from All Aboard Florida; and (2) to <br />approve Resolution 2015-033, supporting that commitment. He stated <br />that a key reason to file the lawsuit would be to challenge the U.S. <br />Department of Transportation's provisional bond allocation approval <br />letter, which was issued improperly prior to completion of the National <br />Environmental Policy Act (NEPA) process. After providing details on <br />the litigation, Attorney Reingold asked the Board to take public <br />comment and authorize staff to file the lawsuit. <br />The Chairman invited public comment; there were no speakers. <br />ON MOTION by Vice Chairman Solari, SECONDED by Commissioner <br />Flescher, the Board unanimously authorized the County Attorney's <br />Office to file a complaint in Federal Court challenging the U.S. <br />Department of Transportation's (FDOT's) approval of the issuance of <br />the $1.75 billion of tax exempt private activity bonds for All Aboard <br />Florida. <br />156-157 <br />Board of County Commission Meeting Page 12 <br />March 17, 2015 <br />Si4eadSoft Reprint Date: Tuesday, August 04, 2015 - 11:08:09 - BCC:2109, Attachment Id 1, Page 12 <br />
