DeBraal, Deputy County Attorney �tf� <br /> DATE: May 12, 2015 <br /> SUBJECT: First Amendment to Lease Agreement with AT&T Mobility for Colocation on <br /> Tower at 1340 Old Dixie Highway Tower <br /> In 1995, the County entered into a Lease Agreement with TALCOM, Inc., for TALCOM to construct <br /> a tower at 1340 Old Dixie Highway. The tower and accessory buildings were completed and are in <br /> operation. Over the ensuing 20 years, the cellular industry has seen frequent mergers and <br /> acquisitions which have resulted in AT&T Mobility, LLC as the current Tenant under the terms of the <br /> Lease. <br /> AT&T Mobility has contacted the County seeking our consent to enter into a colocation agreement <br /> with Verizon Wireless Personal Communications, LP, for Verizon to install an antenna array on the <br /> tower. The First Amendment to Lease Agreement (Amendment) calls for the County to be provided <br /> with engineering reports that will document the tower's ability to handle the increased loading. The <br /> County will also be named as an additional insured by Verizon. <br /> The current Lease runs through 2025. The Amendment will coincide with the current Lease and <br /> provide additional rental income of $12,171.24 annually, subject to a 3% increase in that rate each <br /> year. By executing the Amendment, the County will give its consent to the necessary permitting and <br /> testing that will need to be performed in order to install the new antenna array and associated <br /> equipment on the tower. <br /> Funding: There is no funding associated with this item. <br /> Recommendation: The County Attorney's Office recommends the Board approve the First <br /> Amendment to Lease Agreement for the 1340 Old Dixie Highway site and authorize the Chairman <br /> to execute the Amendment on behalf of the Board. <br /> c: Manny Cabo <br /> Charles F.
