ATTACHMENT 1 <br /> AGREEMENT <br /> BETWEEN <br /> THE DEPARTMENT OF THE ARMY <br /> AND <br /> INDIAN RIVER COUNTY, FLORIDA <br /> FOR THE <br /> INDIAN RIVER COUNTY, FLORIDA <br /> BEACH EROSION CONTROL PROJECT <br /> THIS AGREEMENT is entered into this day of , , by and <br /> between the Department of the Army(hereinafter the "Government"), represented by the <br /> Assistant Secretary of the Army(Civil Works), and Indian River County, Florida, a political <br /> subdivision of the State of Florida, (hereinafter the "Non-Federal Sponsor"),represented by the <br /> Chairman of its Board of County Commissioners. <br /> WITNESSETH, THAT: <br /> WHEREAS,the Feasibility Report for Beach Erosion Control, Indian River County <br /> Beaches,Florida,was completed in August 1980; <br /> WHEREAS,the Report of the Chief of Engineers recommending construction of a shoreline <br /> protection project at Indian River County,Florida(hereinafter the"Project")was signed on <br /> December 21, 1981; <br /> WHEREAS,construction of the Project was authorized bySection 501(a)of the Water <br /> Resources Development Act of 1986, Public Law 99-662; <br /> WHEREAS,the U.S. Army Corps of Engineers has determined that a general <br /> reevaluation study should be undertaken to evaluate the authorized project, using current <br /> planning criteria and policies; <br /> WHEREAS,the Government and the Non-Federal Sponsor desire to enter into an <br /> agreement(hereinafter the"Agreement")to conduct such general reevaluation study(hereinafter <br /> the"Study" as defined in Article I.A. of this Agreement); <br /> WHEREAS, Section 105(a) of the Water Resources Development Act of 1986, Public <br /> Law 99-662, as amended(33 U.S.C. 2215(a)), specifies the cost-sharing requirements applicable <br /> to the Study; <br /> WHEREAS,the Non-Federal Sponsor desires to provide in-kind contributions <br /> (hereinafter the"in-kind contributions" as defined in Article I.K. of this Agreement)that are <br /> necessary to prepare the feasibility report and to receive credit for such contributions toward the <br /> amount of its required contribution for the Study; <br /> WHEREAS,the Non-Federal Sponsor may provide up to 100 percent of its required <br /> 202 <br />
