Office of <br /> INDIAN RIVER COUNTY <br /> ATTORNEY <br /> Dylan Reingold,County Attorney <br /> William K.DeBraal,Deputy County Attorney <br /> Kate Pingolt Cotner,Assistant County Attorney <br /> MEMORANDUM <br /> TO: The Board of County Commissioners <br /> FROM: Dylan Reingold - County Attorney 01" --- <br /> DATE: May 26, 2015 <br /> SUBJECT: Wild Turkey Sand Mine — Second Phase <br /> Cash Deposit and Escrow Agreements for Compliance and <br /> Restoration <br /> In 2009 the Planning and Zoning Commission approved the request for major <br /> site plan and administrative permit use approval for a sand/coquina mine known <br /> as Wild Turkey; and both compliance and restoration security in the form of cash <br /> were posted for Phase 1. <br /> Phase 1 has now been restored to the satisfaction of the County based on site <br /> inspection, and the developer is ready to proceed to the second phase. Before a <br /> permit can be issued for the second phase, security is required to be posted for <br /> compliance and restoration. The developer has chosen to transfer the Phase 1 <br /> compliance and restoration security which is presently in escrow with the County, <br /> to the second phase. Attached for your approval are both the compliance and <br /> restoration Cash Deposit and Escrow Agreements for the second phase - the <br /> compliance security is in the amount of $49,800.00; and the restoration security <br /> is in the amount of $67,710.90. Both agreements earmark the transfer of the <br /> funds from Phase 1 to the second phase. <br /> RECOMMENDATION: <br /> Authorize the Chairman of the Board of County Commissioners to execute the <br /> attached two compliance and restoration Cash Deposit and Escrow Agreements <br /> with regard to the transfer from Phase 1 to the second phase. <br /> /nhm <br /> Attachments <br /> Indian River Co.
