ATRUE COPY <br /> RESOLUTION NO. 2008 053 CERTIFICATION ON LAST PAGE <br /> J.K.BARTON,CLERK <br /> A RESOLUTION BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, <br /> `�• FLORIDA, IN OPPOSITION TO CHANGES MADE TO <br /> COUNTY VALUE ADJUSTMENT BOARDS BY SENATE <br /> BILL/HOUSE BILL 909 <br /> WHEREAS, the Florida House and Senate recently voted to make <br /> changes to Value Adjustment Boards by amending Chapter 193 and 194, <br /> Florida Statutes (2007); and <br /> WHEREAS, the Bill requires the Value Adjustment Board to be advised <br /> by an outside attorney who must be present at every meeting of the Board; and <br /> WHEREAS, the Bill requires the Department of Revenue to create <br /> uniform policies and procedures to be used by special magistrates and Boards; <br /> and <br /> WHEREAS, the Bill permits either the taxpayer or the Property Appraiser <br /> to file a motion alleging a "material violation of the law or rules governing the <br /> hearing of a petition" i.e. an appeal; and <br /> WHEREAS, the Bill requires the Value Adjustment Board to hear these <br /> appeals with its attorney in attendance charging a fee for his or her services; <br /> and <br /> WHEREAS, if the taxpayer or the Property Appraiser disagrees with the <br /> outcome of the appeal before the Value Adjustment Board, that decision can <br /> now be appealed to the Board of County Commissioners; and <br /> WHEREAS, the Bill requires training for special magistrates; and <br /> WHEREAS, the Bill also provides for two citizens of the County to sit on <br /> the Value Adjustment Board; and <br /> WHEREAS, the Bill does not provide any funding to the counties to <br /> provide for the changes in the law; and <br /> WHEREAS, the amendments to the existing law put a disproportionately <br /> greater burden on counties with smaller populations than larger urban <br /> counties, <br /> NOW, THEREFORE BE IT RESOLVED, BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br /> 1. The Board states its opposition to House Bill/Senate Bill 909; and <br /> 2. The Board asks the Honorable Governor Charlie Crist, to veto this bill. <br /> This resolution was moved for adoption by Commissioner Wheeler, and <br /> co. the motion was seconded by Commissioner Bowden, and upon being put to a <br /> vote, the vote was as follows: <br /> 1 <br />
