3/18/97resoxoastaWk <br /> RESOLUTION NO. 97-2 2 <br /> A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA, TO THE <br /> STATE OF FLORIDA REQUESTING THAT THE STATE AMEND PART <br /> III, CHAPTER 161, FLORIDA STATUTES, COASTAL ZONE <br /> PROTECTION, TO ELIMINATE THE FIVE-YEAR ACCUMULATION <br /> PROVISION. <br /> WHEREAS, tropical storms and hurricanes damage coastal homes in Indian River <br /> County as well as thousands of other homes throughout the state; and <br /> WHEREAS, some of these homes will be declared"substantially damaged"due to <br /> the five-year accumulation requirement of the Florida Coastal Zone Protection Act; and <br /> WHEREAS, FEMA's substantial damage/improvement rule neither includes nor <br /> requires an accumulation of damages or improvements; and <br /> WHEREAS, no state, other than Florida, requires a five-year accumulation of <br /> damages/improvements; and <br /> WHEREAS, most houses would not be considered "substantially damaged" <br /> without the accumulation requirement; and <br /> WHEREAS, Indian River County does not want anyone living in unsafe houses <br /> and does not want to preclude any necessary repairs to storm damaged homes; and <br /> WHEREAS, Indian River County recognizes the need for ordinances to minimize <br /> future damage and to reduce the hazards to our residents who live in the coastal areas; <br /> and <br /> WHEREAS, the federal government and the state have developed or are <br /> developing mitigation policies to accomplish this goal; <br /> NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA,that: <br /> 1. The Legislature and the Governor of the State of Florida are urged to abolish the five- <br /> year accumulation requirement associated with the federal flood insurance program. <br /> 2. The Legislature is requested and urged to repeal the five-year accumulation <br /> requirement contained in the Coastal Zone Protection Act of 1985. <br /> 3. A copy of this resolution shall be sent to the Honorable Governor Lawton Chiles and <br /> the Legislators, the Florida League of Cities, and the State Association of Counties, <br /> and shall constitute a request for the abolishment of the five-year accumulation <br /> requirement; and for a repeal of said requirement contained in Sections 161.52 <br /> through 161.58, F.S. <br />
