T-Mobile Dodgertown Cell License <br /> June 30, 2015 <br /> 2 I Page <br /> The license agreement provides for the exclusive use of a 300 square foot parcel of <br /> property beneath the light pole to be used for the necessary ground equipment. The <br /> agreement contains an easement for ingress and egress so as to access the equipment. <br /> The County would be listed as an additional insured and indemnified by T-Mobile. If the <br /> proper government approvals are not obtained, the agreement would become null and void <br /> and T-Mobile would return the site to its original condition. Permitting from the City of Vero <br /> Beach would be necessary as the property lies within its City limits. <br /> FUNDING: <br /> The lease payments received under this agreement will be deposited into the County's <br /> General Fund, in account number 001038-362011 (Radio Tower Rents). <br /> OPTIONS: <br /> 1. Approve the License Agreement with T-Mobile with the annual 4% increase in license <br /> fees. <br /> 2. Reject the License Agreement and direct staff to renegotiate its terms. <br /> 3. Reject the License Agreement and direct staff to discontinue negotiations with T- <br /> Mobile. <br /> RECOMMENDATION: <br /> Staff recommends the Board select Option 1 and approve the License Agreement with the <br /> 4% annual license fee increase and authorize the Chairman to sign the attached License <br /> Agreement and Memorandum of License on behalf of the Board, and any other documents <br /> necessary to effectuate said agreement and delegate authority to the County Attorney or <br /> his designee to execute any permit application necessary for tower plan review and <br /> construction. <br /> Attachments <br /> Copies to: Manny Cabo <br /> Joe O'Hagan, SBA <br /> 129 <br />
