WHEREAS, the [City/County] desires to exercise its powers and zoning authority to prohibit well <br /> stimulation at oil and gas exploration and production wells to prevent any damage to the <br /> community and protect health, safety and welfare. <br /> THEREFORE, BE IT ORDAINED BY THE[CITY/COUNTY]: <br /> Section 1. Purpose and Intent <br /> The purpose and intent of this Ordinance is to amend the zoning code "schedule of uses" in <br /> each zoning district to expressly prohibit well stimulation uses for oil and gas exploration and <br /> production. <br /> Section 2. Applicability <br /> The provisions of this Ordinance shall apply to all oil and gas exploration and production well <br /> uses within the [City/County]. <br /> Section 3. Definitions <br /> The definitions section of the [City/County] Land Development Code Section shall be <br /> amended as follows <br /> (new language is underlinedexisting deleted language shown as strikethreugt): <br /> DEFINITIONS: <br /> For the purposes of the (City/County] Land Development Code, "well stimulation"shall <br /> mean a well intervention, exploration, operation,or maintenance procedure performed <br /> by injecting fluid into a rock formation in order to increase production at an oil or gas <br /> well by improving the flow of hydrocarbons from the formation into the wellbore.
