Board of County Commissioners <br />July 10, 2015 <br />Page 2 of 2 <br />On February 14, 2012, in an attempt to encourage payment of the accrued service availability charges, <br />the Indian River County Board of County Commissioners (the "Board") adopted Ordinance 2012-001 <br />which created an amnesty period from February 14, 2012 through March 31, 2012, during which <br />delinquency charges would be waived if service availability charges were paid in full. Five accounts <br />were paid in full during that period, with $134,950.13 collected and $98,432.33 of charges waived. <br />After the amnesty program closed, staff and individual commissioners were approached by property <br />owners who said that, for a variety of reasons related to the short duration of the program, they were not <br />able to take advantage of it. Therefore, on April 2, 2013, the Board adopted Ordinance 2013-002, <br />establishing another amnesty period from April 2, 2013 through August 31, 2013. During this second <br />amnesty period, twelve accounts were paid in full, with $323,883.10 collected and $125,891.84 of <br />charges waived. In total, the two amnesty periods resulted in seventeen accounts being paid in full, and <br />$458,833.23 being collected and $224,324.17 in charges being waived. These programs were available <br />only with respect to ERUs which were reserved for future use, but for which there had been no prior use <br />or consumption. On July 7, 2015, the Board directed the County Attorney to draft an ordinance <br />establishing a new amnesty program. The proposed amnesty period will be from July 24, 2015 through <br />October 31, 2015. As with previous amnesty periods, the Utilities Department will notify owners of this <br />new amnesty period. <br />RECOMMENDATION. <br />The County Attorney recommends that the Chairman open the public hearing, take comments from the <br />public and then close the public hearing, and that the Board then adopt the attached proposed amnesty <br />ordinance. <br />ATTACHMENT(S). <br />Proposed Ordinance Establishing Amnesty Program for Certain Utility Delinquency Charges <br />F.
