After considerable discussion and consideration in the matter, and the Board <br />realizing they did not or would not have sufficient funds for the completion of the work <br />during this or the next fiscal year, no action was taken on any of the bids which were re- <br />ceived and they were ordered filed with the Clerk. <br />Upon motion made by Commissioner Stewart, seconded by Commissioner Waddell and <br />carried, the Board authorized and directed the Chairman and Clerk to execute an Agreement <br />between the trustees of the property of Florida East Coast Railway Company and Indian River <br />County relating to a railroad crossing at Gifford, Florida, identified as MP 225 plus:. 632'. <br />A copy of the Agreement together with a blueprint of said crossing is filed in the Clerk's <br />office. <br />It is understood that q proximately $75.00 representing costs in connection with <br />the foregoing crossing will be paid by Charles S. Buster. <br />It was moved by Commissioner Stewart, seconded by Commissioner Waddell and <br />carried, and the Attorney and Clerk of this Board was directed to make application for land <br />from the Federal Government to be used for public recreation purposes, said land to be <br />located on the beach and north of the former Coast Guard station. <br />It was moved by Commissioner Stewart, seconded by Commissioner Waddell and <br />carried, and the Clerk was instructed to deposit the sum of $1172.00 from the Road and <br />Bridge Fund to the Registry of Court Fund being double the amount of $86.00 which amount <br />was recommended by the appraisers who were appointed by the Court to appraise five (5) <br />parcels of land for rights-of-way of State Road No. A1A. <br />Notary Public Bond for Howard B. Woodward in the sum of $00.00 with American <br />of New York <br />Surety Company/as ,surety was . approved . Augu$t-47-..by Douglas Baker, Clerk. Circuit- Court, as <br />provided by law. <br />Notary Public Bond for: Anne Eckhoff In the sum of $500.001.with. American. Surety <br />of New York - <br />Company/as surety was approved August 11 by Douglas Baker, Clerk Circuit Court, as provided <br />by law. <br />Notary Public Bond for Marion M. Carter and Idinspected my property located on lateral A <br />(Tract 16, Sec. 7, Twp. 32, Rge 39) to determine the amount of this property needed for road <br />right of way. Mr. Carter etermined that it would he necessary to take the East 30 Test of <br />this tract. <br />In view of the fact that I will lose my windbreak, irrigation ditch, road and eventually a <br />row of trees I feel that I should be reimbursed for the property. I would be willing to <br />accept $1000.00 for the property (East 30 feet) with the understanding that the County will <br />pay the cost of having my two 4 inch artesian wells cut off and piped inside of my new <br />property line. It is further understood, that,.if at any time in the future it becomes <br />necessary or desirable for me to remove the East row of citrus trees the County will do <br />this work and dispose of the trees at County expense. <br />Mr. B. C. Spitzley,300 Murray Road, West Palm Beach, Fla. holds a mortgage on the above <br />property. I have ried several times to contact Mr. Spitzley by telephoneto see if he <br />would be willing to sign a release but have been unable to reach him. I assume that he is <br />out of the state on vacation. , <br />
