ORDINANCE NO. 2015- 012 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING ORDINANCE AND <br />ZONING MAP FOR APPROXIMATELY ±4L95 ACRES, LOCATED EAST OF U.S. #1 AND NORTH OF 82nd <br />STREET, FROM CG, GENERAL COMMERCIAL DISTRICT; TO OCR, OFFICE, COMMERCIAL, <br />RESIDENTIAL DISTRICT; AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency <br />on such matters, held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County; and <br />WHEREAS, the Board of County Commissioners held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; <br />NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of Indian <br />River County, Florida, that: <br />The zoning of the following described properties situated in Indian River County, Florida, to wit: <br />LEGAL DESCRIPTION PARCELS 1 A AND 1B <br />(PORTIONS OF OFFICAL RECORDS BOOK 2350, PAGE 1570) <br />PARCEL "IA": <br />A PARCEL OF LAND LYING IN SECTION 33, TOWNSHIP 31 SOUTH, RANGE 39 EAST, <br />INDIAN RIVER COUNTY, FLORIDA, BEING THE NORTHEAST QUARTER OF THE <br />SOUTHEAST QUARTER OF THE NORTHEAST QUARTER, LESS THE SOUTH 35.00 <br />FEET THEREOF FOR ROAD RIGHT OF WAY; AND ALSO LESS THE SOUTH 208.71 <br />FEET OF THE EAST 208.71 FEET. <br />PARCEL "IB": <br />ALL THAT PART OF THE NORTHWEST QUARTER OF THE SOUTHEAST QUARTER OF <br />THE NORTHEAST QUARTER OF SECTION 33, TOWNSHIP 31 SOUTH, RANGE 39 EAST, <br />LYING EAST OF THE NEW FOUR LANE U.S. HIGHWAY NO.1, INCLUDING THAT <br />PORTION OF LOT 2, BLOCK 3, OF REPLAT OF WABASSO MANOR ADDITION, AS <br />RECORDED IN PLAT BOOK 6, PAGE 15, INDIAN RIVER COUNTY, FLORIDA PUBLIC <br />RECORDS, LYING EAST OF SAID U.S. HIGHWAY NO.1. <br />
