ORDINANCE NO. 2015- 013 <br />AN ORDINANCE OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, AMENDING INDIAN RIVER COUNTY CODE <br />SECTION 901.03 DEFINING COMMERCIAL EVENT AT <br />RESIDENCE AND SECTIONS 911.15 AND 912.18 <br />PROHIBITING COMMERCIAL EVENTS AT RESIDENCE, <br />PROVIDING FOR CODIFICATION; PROVIDING FOR <br />SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, it has become increasingly popular to hold weddings, family <br />reunions and other celebrations at single family homes that are rented out specifically <br />for the event or the occasion; and <br />WHEREAS, owners or the owner's agents of the homes advertise that the <br />residential property is capable of accommodating a commercial type event, complete <br />with dancing and catered food for a large gathering of people; and <br />WHEREAS, single family homes and neighborhoods are not designed to handle <br />the traffic, noise, litter and parking problems associated with large commercial events; <br />and <br />WHEREAS, surrounding homes and neighborhoods adjacent to a house leased <br />out for these types of events must deal with frequent loud parties and receptions <br />making them more like neighbors to a country club or a reception hall complete with live <br />or recorded music, tents, outdoor dining and valet parking services; and <br />WHEREAS, owners of the event homes are not in attendance and are seeking <br />out extra income at the expense of their fellow neighbors; <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />SECTION 1. AMENDMENT. <br />Section 901.03 - Definitions in alphabetical order: <br />Commercial amusement, unenclosed no change. <br />Commercial event at residence a gathering of people for a celebration that may <br />include but not be limited to a: birthday, anniversary, wedding, reunion or sporting event <br />characterized by music (live or recorded), dancing, catered food, tents, outdoor tables, <br />alcohol or use of shuttles or valet for guests. <br />1. Held or occurring at single family residence. <br />2.
