Walton • - To: The Board of County Commissioners of Indian River County,Florida Gentlemen: There is recorded in Plat Book 2, pages 37 and 38s in the office of the Clerk of the Circuit Court of Indian River County, Florida, a plat of Ocean Beach Road Survey in Township 33 South, Range 40 East, Indian River County, Florida, which said survey as shown upon said plat began at the SoUth unite of the City of Fero Beach, Florida, and ran South to the South line of Indian River County through property now owned by the undersigned and other citizens of this County. As you know, there was recently completed Florida State Road AlA from Beachland Boulevard in the City of Vero Beach, Florida, South to the South line of Indian River County, Florida, and that the right of way for said State Road AlA was obtained by the Board of County Commissioners of Indian River -County, Florida, from the property owners'affected by the plat above referred to and that said State Road AIA parlIallels and follows in a general way the plat of Ocean Beach Road Survey except that said Ocean Beach Road Surtsey is located closer to the Atlantic Ocean than said Florida State Road AlA. I wish to call your attention to the fact that this plat of Ocean Beach Road Survey was placed of record as above recited and that the same constitutes a cloud upon the title of your Petitioner and others similarly affected.. That said Ocean Beach Road as set fpnth in said plat above referred to was not approved by any of the property owners affected, that the right of way as shown upon said plat was not conveyed by the affected property owners and that the road shown upon said plat has never been laid out, used or established and that neither the Board of County Commissioners of.Indian River County, Florida, nor has any other public body acquired icy condemnation or otherwise any right, title or interest in and to the right of way shown upon said plat. Your Petitioner therefore respectfully requests this Board to publish a notice of a hearing with respect to this matter as required by law and that after such public hearing, this Board adopt a Resolution closing, vacating and abandoning the road and renouncing and disclaiming any right in any land delineated on said recorded.plat as a street, road or high- way. Smith, Jr., Attorney, to publish and prepare a notice of -a --hearing with respect to this matter as required by law and after such public hearing, this Board abgnd oning adopt Resolution closing, vacating, and/ &M the road. Chairman, Tom N. Stewatt, presented a check to the Board in the sum of $28.23, repre- senting tbacrefund to the County on the cost of.the dedication of the Merrill P. Barber Bridge and was ordered placed in the General Revenue Fund. The following were appointed Deputy Sheriffs by L.,B.
