Original <br />AGREEMENT TO PURCHASE AND SELL REAL ESTATE <br />BETWEEN INDIAN RIVER COUNTY <br />AND <br />AUDREY GRAVES SEXTON, AS TRUSTEE OF THE AUDREY GRAVES <br />SEXTON TRUST U/AID MAY 31, 2005 <br />THIS AGREEMENT TO PURCHASE AND SELL .REAL ESTATE ("Agreement") is <br />Made and entered into as of the day of October , 2015, by and between Indian River <br />County, a political subdivision oo the State of Florida ("the- County"),. and Audrey Graves <br />Sexton, as Trustee' of the Audrey Graves Sexton Trust UTA/D May -31:, 2005, who agree.as <br />follows: <br />WHEREAS, Audrey Graves Sexton,. as Trustee owns a 19:84 acre parcel of <br />property located east of 66th'Avenue acid :9th Street SW, Vero Beach, Florida. A sketch and <br />legal description of the. propertyshowing the .proposed :right-of=way to be purchased, is <br />attached to this agreement. as Exhibit "A" and incorporated by reference herein; and <br />WHEREAS, Audrey Graves Sexton is the Trustee of the Audrey Graves Sexton <br />Trust U/ND May 31, 2005; and <br />WHEREAS, the County is scheduled to expand the intersection of 66th Avenue and <br />9th Street:SW in the future and the road: expansion will impact the Audrey Graves Sexton <br />Trust property;. and <br />WHEREAS,..in orderforthe County -to proceed with its road intersection expansion <br />.plans, the: County needs to purchase property to be used as right-of-way from the Audrey <br />Graves Sexton Trust; and <br />WHEREAS, after negotiations with the County, The Audrey Graves Sexton Trust <br />has agreed -to sell bathe •County the needed right-of-way of approximately 55;508 square <br />feet or 1:27 acres of property as depicted on Exhibit "A", referred to as the Property; and <br />WHEREAS, The Audrey Graves Sexton Trust and the ;County wish enter into this <br />agreement for the _purchase. of the Property; <br />NOW, THEREFORE, in consideration of the mutual terms, conditions, promises, <br />covenants and .premises hereinafter, the County and The Audrey Graves Sexton Trust <br />agree asfollows: <br />1.
