4. A major requirement of the City of Sebastian Acquisition Agreement is the City's obligation to enact <br />a three phase assessment program to serve approximately 9,000 parcels in the Sebastian Highlands <br />at a projected cost of approximately $9,000,000. As the three phases are the parcels of property that <br />aro specifically beaefrtted, they will be assessed for the pro -rata share of the costs of the project and <br />the assessments will become a part of the revenues pledged to the Series 1996 Bonds. <br />1. The expansion of the South County Wastewater Treatment Plant to provide an additional 1.150 <br />MGD of wastewater treatment capacity at an approximate cost of $6,500,000. <br />2 The expansion of the Central Wastewater Treatment Plant to provide an additional 1.0 MGD of <br />wastewater treatment capacity at an approximate cost of $6,000,000. <br />3. The design and construction of approximately 10,700 linear feet of sewer force main along County <br />Road 510 to connect the North Beach sewer collection system to the mainland collection system and <br />to provide service to the developments along County Road 510 at an approximate cost of $1,500,000. <br />4. The design and construction of approximately 18,100 linear feet of force main and a regional <br />wastewater pumping station to interconnect the North County Wastewater Treatment Plant and the <br />Central Wastewater Treatment Plants at an approximate cost of $630,000. <br />Combined System <br />Overall, the County's goals and objectives are to design/construct new water and wastewater facilities <br />as required in the Comprehensive Plan in the Utilities Master Plan to provide potable water and wastewater <br />service to the greatest number of new customers as possible. The goals and objectives include expanding the <br />existing water and wastewater facilities to serve additional developments, evaluate existing facilities and renovate <br />as needed to improve service to existing customers, continue to acquire existing water and wastewater franchise <br />utilities and create assessment districts to provide water and wastewater services to undersized lots throughout <br />the County. Based on County Ordinance 91-09, it is the County's opinion that the water and wastewater rates <br />that have been adopted are sufficient to provide the funds to complete the projects as specifically described above <br />without increasing rates in the next several years. In the future, as the County pursues the goals and objectives <br />that are dumbed in this paragraph, it may be required to implement water and wastewater rate increases as <br />the County funds additional projects. <br />LITIGATION <br />In the opinion of the County Attorney, no legal proceedings are pending or threatened that materially <br />affect the County's ability to perform its obligations to the holders of the Series 1996 Bonds or that materially <br />affect the fuiancial condition of the System. <br />In the opinion of the County Attorney, there is no litigation or controversy of any nature now pending <br />or, to the County's knowledge, threatened to restrain or enjoin the issuance, sale, execution or delivery of the <br />Serio 1996 Bonds or in any way contesting the validity of the Series 1996 Bonds or any proceedings of the <br />County taken with respect to the authorization, sale or issuance of the Series 1996 Bonds or the pledge or <br />application of any moneys provided for the payment of the Series 1996 Bonds. <br />25 <br />
