DeBraal, Deputy County Attorney <br /> r <br /> DATE: June 30, 2015 <br /> SUBJECT: Public Hearing for Adoption of an Ordinance Establishing the Oceanside <br /> Replat Street Paving Municipal Service Benefit Unit <br /> This is the second and last public hearing required to establish the creation of a new <br /> Municipal Services Benefit Unit (MSBU) to recover the costs of street paving <br /> improvements to be done in the Oceanside Replat area. You will recall that this area is <br /> east of Highway A-1-A between Porpoise Point and Floraton Beach Subdivisions and <br /> consists of 42 lots, with 36 benefited parcels comprising the unit. The property owners <br /> asked the County for assistance with re-paving and have expressed a willingness to <br /> fund the street paving improvements through a specially established MSBU. The <br /> proposed MSBU covers paving costs and would sunset after the fifth year of <br /> assessment. Indian River County Code provides for the establishment of additional <br /> services within districts, as authorized under Section 125.01, F.S., and for collection of <br /> non-ad valorem assessments pursuant to the uniform method found in Florida Statute <br /> §197.3632. <br /> On January 20, 2015, the Board held the first Public Hearing and adopted a resolution <br /> that stated: <br /> • the Oceanside Replat Street Paving MSBU is necessary to further the health, <br /> safety and well being of those residing and owning property within the <br /> boundaries of the district and <br /> • the Board intends to use the uniform method of collecting the non-ad valorem <br /> assessments found in Florida Statute §197.3632 <br /> Itndi:n River Cn APP(Oved Date <br /> l/ Admin. <br /> r'�-RUFD FOR ry_/JF Leoa1 <br /> B.C.C.
