ORDINANCE NO. 2015- 016 <br />AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, AMENDING CHAPTER 800, Title <br />VIII, COMPREHENSIVE PLAN, OF THE CODE OF INDIAN RIVER <br />COUNTY, AND PROVIDING FOR CODIFICATION; SEVERABILITY; AND <br />EFFECTIVE DATE. <br />WHEREAS, the Board of County Commissioners adopted Chapter 800 of the County <br />Code on September 18, 1990; and <br />WHEREAS, since Chapter 800's adoption, the Chapter 163, Part II, Florida Statues, <br />has been changed and the Florida Administrative Code (FAC) Rule 9J-5 has been deleted. As <br />a result, references in Chapter 800 to the Chapter 163, Part II, Florida Statues and the deleted <br />Rule 9J-5, Florida Administrative Code citations are outdated and, therefore, those references <br />must be updated; and <br />WHEREAS, there are many sections of the state's Chapter 163, Part II, Florida <br />Statues requirements that were repeated verbatim in Chapter 800. Because of that structure, <br />Chapter 800 wording of state requirements becomes out of date whenever the state changes <br />its requirements. To avoid that problem, Chapter 800 needs to be modified to merely refer to <br />state statutes rather than recite state requirements; and <br />WHEREAS, several sections of Chapter 800 must either be updated or revised to <br />clarify the current condition. Those revisions are minor in nature and are needed throughout <br />Chapter 800; and <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County <br />Commissioners of Indian River County, Florida that: <br />SECTION ONE: AMENDMENT OF CHAPTER 800. <br />Chapter 800 of the Indian River County Code is hereby amended to read as shown in <br />Appendix A, attached. <br />SECTION TWO: CODIFICATION. <br />It is the intention of the Board of County Commissioners that the provision of this ordinance <br />shall become and be made part of the Indian River County Code, and that the sections of this <br />ordinance may be renumbered or re -lettered and the word ordinance may be changed to <br />section, article or such other appropriate word or phrase in order to accomplish such <br />intention. <br />1 <br />
