INC <br />The Board reviewed a Memorandum of September 17, 2002: <br />MEMORANDUM <br />TO: The Board of County Commissioners <br />FROM: William G. Collins II — Deputy County Attorney <br />DATE: September 17, 2002 <br />S UBJECT: 77"' Street Paving Escrow Agreement — Henry Fischer & Sons, Inc. <br />O n June 13, 2002 the Planning and Zoning Commission approved Henry Fischer <br />& Sons, Inc.'s request for a major site plan and administrative permit use <br />approval for a sand mine operation, subject to several conditions, one being that <br />prior to the November construction of 77"' Street, Henry Fischer & Sons, Inc <br />escrow its fair share for paving the sand mine operation's 77"' Street frontage. <br />H enry Fischer & Sons, Inc. has escrowed $36,467.00 for its fair share of paving, <br />and executed an escrow agreement to that effect. <br />RECOMMENDATION: <br />Approve the attached '77th Street Paving Escrow Agreement" and authorize the <br />Chairman and Administrator to execute same. <br />OCTOBER 1, 2002 38 <br />
