Mensing, et al.; Case No. 2002 0445 CA 09; Circuit <br />Court, Nineteenth Judicial Circuit in and for Indian River County <br />Recommendation: <br />Authonze continued engagement of Clem, Polackwich, Vocelle & Berg, L L P, in the <br />above -referenced case, and authorize expenditure of an amount up to $5,000 over and <br />above an initial administrative $5,000. <br />D iscussion: <br />On February 5, 2002, the Board of County Commissioners authorized code <br />e nforcement staff to engage counsel to file an inunction action against Fred Mensing. The <br />B oard also authorized the county attorney to foreclose code enforcement liens. Clem, <br />Polackwich, Vocelle & Berg, L L P was engaged at rates of $150/hr./partner, $140/hr./ <br />associate, and $75/hr./paralegal. Rather than maintaining two lawsuits, I authorized <br />Attorney Polackwich to include a foreclosure count in his Complaint. The litigation is <br />u nderway. Fees and costs to date total $4,318.01. <br />Inasmuch as the County Administrator is authorized by ordinance to expend up to <br />$5,000, it is requested that. the Board authorize expenditure of an amount up to $5,000 <br />over and above an initial administrative $5,000.
