Gorham, Ph.`15. crud. <br />Coastal Resources Manager <br />SUBJECT: Resolution to Florida Department of Environmental Protection <br />requesting establishment of an Erosion Control Line for the <br />Sectors 1&2 Beach Restoration Project <br />September 20, 2002 <br />DESCRIPTION AND CONDITIONS <br />As a part of the permitting process for a beach restoration <br />project, the State requires that an Erosion Control Line (ECL) be <br />established for the project area. The ECL identifies the location <br />of Mean High Water (MHW) level in the project area, the traditional <br />dividing line between private property to landward and public <br />property to seaward. Once an ECL has been established, it becomes <br />the new dividing line between public and private property, ensuring <br />that new beach land created seaward of the previous MHW line is <br />public property. The County has surveyed the beach in the Sector <br />1&2 project area to determine the position of MHW and provided for <br />property owner notification and public notice of the ECL workshop <br />and public hearing required by Statute, which was held on September <br />18. The State also requires a resolution from the Board of County <br />Commissioners, formally requesting that an ECL be established for <br />the project area. <br />RECCMMMNDATlONS AND FUNDING <br />Staff recommends approval of the attached resolution to the Florida <br />Department of Environmental Protection. <br />OCTOBER 1, 2002 48 <br />
