Conclusion <br />The subject right-of-way is not part of the roadway system as noted on the County's thoroughfare <br />plan and is not needed for the thoroughfare plan system. The abandonment would not eliminate <br />access to any properties. Additionally, the abandonment would presen e the existing traffic pattern, <br />while giving the adjacent property owners greater use of their land. Retaining an access, drainage, <br />and utilities easement over the right-of-way segment will preserve benefits for Grovenor Estates <br />residents and the county. The County Attorney's Office has reviewed and approved the attached <br />abandonment resolution for legal form and sufficiency. Therefore, in staffs opinion the proposed <br />abandonment is warranted. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of County Commissioners abandon <br />its rights to the subject 15' Street S.W. right-of-way segment and authorize the Chairman to execute <br />the attached abandonment resolution, with the following condition: <br />1. That over the segment of right-of-way to be abandoned an access, drainage, <br />pedestrian and utility easement be retained for public use. <br />ATTACHMENTS: <br />1. Application <br />2. Resolution <br />Planning Director Stan Boling stated that the street will remain an easement and the <br />ability to turn around there will be kept. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. <br />Attorney Bruce Barkett, representing the applicant, stated that the design for the <br />project has already been approved.
