This <br /> is a lovely place and she would hate to see development happen here as it did in South <br /> Florida . <br /> Director Keating reported on his investigation into the land clearing permit and noted <br /> that a limited land clearing permit has been given which only allows clearing underbrush in <br /> specific areas . <br /> Commissioner Stanbridge asked whether code violations are being checked out , and <br /> Director Keating stated that it will be checked . <br /> Commissioner Macht felt the wording of the permit should be checked in an effort to <br /> make certain that it cannot be too widely interpreted and the clearing go too far before the <br /> plans are approved . <br /> Attorney Evans stated that this property is zoned multi - family and the height of the <br /> building meets the requirements of the LDRs . His client has made an application for this <br /> project and all regulations of the LDRs have been met . If this were a single- family <br /> residence , there would never have been a site plan and no discussion about erosion at the <br /> County level . The zoning permits what the applicant has applied for . The basic issue is <br /> whether the Board can deny the project because it is seaward of the 1987 CCCL . Chapter <br /> 161 , F . S . , states that the County may regulate construction in the area between the 1987 and <br /> the 1981 CCCL if the county develops rules and regulations and submits a request to the <br /> DEP to undertake this regulation . That has not happened in this county . The County does <br /> not, therefore ,. have the authority to grant or deny permits without statutory DEP approval . <br /> This County has the practice of sending these requests to DEP and the CCCL is regulated <br /> by DEP .
