Environmental, native uplands, and tree protection requirements apply to <br />the "project site". <br />OTE: This criterion results in conservation easements for upland <br />setaside areas and avoidance or mitigation of wetland impacts. <br />Private property owners associations must be established where common <br />areas or private road rights-of-way are created. <br />NOTE: Plats for private road rights-of-way (unpaved private roads) may <br />be filed in conjunction with affidavit of exemption projects to create new <br />private road frontage for new parcels. Such roads are dedicated to private <br />property owners associations. <br />No affidavit of exemption or aggregation of affidavits of exemption shall <br />result in the creation of 50 or more parcels. <br />NOTE: This criterion means that a single affidavit of exemption request, <br />or aggregation of requests from the same owner on adjacent sites, cannot <br />exceed a total of 49 new parcels. Such a 49 parcel "project" would cover <br />a minimum of + 245 acres. To date, the Largest approved affidavit of <br />exemption request created only 7 parcels. Staff anticipates receiving the <br />11 parcel Ralph Lindsey request shortly. <br />No affidavit of exemption shall cover agriculturally designated properties <br />(lands located outside the Urban Service Area). <br />NOTE: This criterion means that the affidavit of exemption process can be <br />applied only on lands inside the Urban Service Area only. <br />Affidavits of exemption are exempt from platting requirements (unless private road right- <br />of-way is proposed). In addition, affidavits of exemption are exempt from providing <br />infrastructure improvements, including: streets, utilities systems, storniwater management <br />systems, bikeways, sidewalks, and streetlights. After parcels are created, however, <br />stormwater management and water and wastewater requirements are applied during the <br />review for single family homes on individual parcels. <br />Thus, the affidavit of exemption criteria address some of the most basic development <br />issues (road frontage and access, minimum public road right-of-way standards, <br />environmental regulations, and overall project size) and defer utility and drainage matters <br />to the time of building permit review. The exemptions delete infrastructure improvement <br />requirements that are common in residential subdivisions. In essence, the county exempts <br />requirements for such improvements to allow a low density rural lifestyle without urban <br />services and paved roads, at a lower development cost <br />• Affidavit of Exemption Process <br />In addition to reduced infrastructure requirements, the affidavit of exemption process is <br />less extensive than the platting process. Platting requires that an applicant go through a <br />pre -application process with staff, obtain Planning and Zoning Commission preliminary <br />plat approval, obtain a land development permit from Public Works, construct or "bond - <br />out" for improvements, obtain final plat approval from the Board of County <br />Commissioners, and have the plat and associated documents recorded. The affidavit of <br />exemption process is shorter, requiring an applicant to go through a pre -application <br />JANUARY 22, 2002 <br />
