The Complaint was served yesterday , and a responsive <br /> pleading is due February 5 , 2001 . In light of the specialized area of the law involved , and <br /> the time that it would take to defend such a lawsuit , it would be appropriate to engage <br /> outside legal counsel for this case . <br /> Inasmuch as agenda materials are due in the County Administrator' s Office by noon <br /> today , it has not been possible to make a recommendation of a particular attorney or law <br /> firm within twenty-four hours from the time of service . The deadline for response to the <br /> Complaint precedes the February 6 , 2001 , regular Board meeting . <br /> PGB <br /> County Attorney Bangel informed the Commissioners that, subsequent to the agenda <br /> deadline and preparation of the above memo , he had learned that the County ' s excess <br /> insurance carrier, Florida League of Counties , will defend Indian River County in the above <br /> lawsuit . Therefore , the request in the above memo is moot . <br /> In response to Vice Chairman Ginn ' s understanding, he advised that the same finn <br /> will defend two municipalities in similar lawsuits with Nextel . <br /> 13 . Be VICE CHAIRMAN STANBRIDGE — LOST TREE ISLANDS <br /> Vice Chairman Stanbridge advised of a proposed agreement now in Tallahassee <br /> concerning the Lost Tree Islands . She viewed this as another attempt to " end run " the legal <br /> process . She explained her understanding of the matter which was scheduled to go before <br /> the Trustees of the Internal Improvement Fund on February 6 , 2001 . <br /> ( CLERK ' S NOTE : Subsequent to the meeting , Vice Chairman Stanbridge wrote a <br /> memorandum dated January 23 , 2001 , concerning this matter and that memorandum is <br /> inserted below giving available information . ) <br /> January 23 , 2001 <br /> 79 <br />
