HOTCHKISS, P.E. <br />AND STAH.ED CAPITAL PROJECTS MANAGER <br />BY DEP ARM/ENT OF L 1'1LITY SERVICES <br />SUBJECT: SUBORDINATION OF UTILITY EASEMENT AT THE Th.TERSECTION <br />OF 6'H AVENUE AND U.S. HIGHWAY ONE <br />BACKGROUND AND ANALYSIS <br />The Florida Department of Transportation (1tDOT) is requesting that the Department of Utility <br />Services subordinate a 10' wide utility easement located on private property (see attached <br />subordination agreement). The easement is used to protect the interest in a 3" diameter force main <br />located at the intersection of U. S. Highway 1 and 6th Avenue. <br />The subordination agreement will allow the FDOT to gain primary control over the easement similar to <br />how they regulate their right-of-ways. Wording in the agreement states that FDOT will be "willing to <br />participate" in any utility relocation should it be necessary. Ann Endsley, Utility Coordinator with the <br />FDOT assured staff that the FDOT will pay for like -for -like utility relocation (see attached letter from <br />Ann Endsley dated July 30, 2002) Therefore, staff recommends that the Board adopt the resolution <br />provided by the FDOT and execute the attached subordination agreement. <br />NOVEMBER 12, 2002 <br />137 <br />ami <br />• <br />i u <br />:3 <br />v <br />
