However if a land development permit is not obtained by December 31, <br />2002 and the reverter is not deleted, then the PD project apprcv al would be voided. Therefore, <br />the applicant is requesting that the reverter be removed to guarantee that the PD project approval <br />will remain in effect beyond December 31, 2002. Because the property has been acquired by the <br />developer, the reverter is no longer necessary. Staff supports the request <br />RECOMMENDATION <br />Based on the analysis, staff recommends that the Board of County Commissioners grant approval <br />to delete the zoning reverter date from the Colony PD zoning ordinance. <br />ATTACHMENTS <br />1. There being none, the Chairman closed the public hearing. <br />ON MOTION by Commissioner Ginn, SECONDED by <br />Commissioner Tippin, the Board unanimously adopted Ordinance <br />2002-029 amending Ordinance 2001-036 by deleting the zoning <br />reverter clause for property known as "The Colony P.D." <br />consisting of approximately 297 acres of land generally located <br />between 13th Street SW on the north, 17th Street SW on the south, <br />27th Avenue on the east, and 43rd Avenue on the west. <br />NOVEMBER 12, 2002 <br />57 <br />• <br />
